we just found out it involves an off duty police officer and a would-be robber. lucky to be alive. that is how a father and son feel this morning after being rescued from their downed plane at sea. we are live in milpitas where police are investigating its first homicide of the year. we'll tell you what happened inside a 7-eleven. and president obama scores a victory in the race for the white house. what democrats were able to do that they haven't done in the last four months. it's all ahead on the ktvu channel 2 morning news. good morning. thank you for joining us. it is monday, september 10th i'm pam cook. >> and i'm dave clark. let's check weather, traffic, we first go to steve paulson who knows about the weather. >> pam, you need to check your e-mail it's purple today. >> i know. i'm sorry i missed that. >> missed that one. weekend. especially on sunday. it looks like we'll reverse that a little bit. there is still fog on the coast. temperature there is don't change too much. 60s and 70s around the bay. here is sal. steve, good morning. this is a look at interstate 880. it looks like they picked up the road work here on 880 northbound passing the coliseum. traffic is good. they will have a busy day there today. it is 5:00 let's go back to dave and pam. thank you. we have new developments this morning. it's about an overnight shooting that happened in oakland. now we are finding out an off duty police officer shot a man that tried to rob him. this happened about 2:00 this morning on lee street right near lake merit. the police officer and his female companion were getting out of their car when a gunman approached them. that is when the officer pulled out his gun and shot that suspect in his arm and chest. that suspect was taken to a hospital. listed in table condition -- listed in stable condition.

alex savidge is out there. he'll have much more coming up at 5:30. rescued from a down plane. sinking in the ocean. it happened off the central coast yesterday. tara moriarty joins us from the coast guard station at sfo with new video of that rescue. >> reporter: a father and son were an their annual flight from santa barbara to canada. it happened yesterday afternoon off the coast of southern big surf. the san francisco coast guard made a dramatic rescue. they provided us with this video. the father and son made the may day call just after 2:00 yesterday afternoon. officials say it was a gps tracking device on board their aircraft that helped pinpoint them. >> the big thing they had they had 46 perks on board that sent up a signal to a satellite that was able to go to a rescue

coordinator. that device helped save their life. >> now the older man was suffering from hyperthermia and both victims ended up being okay. now coming up we will tell you about the challenging conditions crews had to deal with and what the victims said when they were saved. live at sfo i'm tara moriarty. >> time is 5:02. a #-eleven -- a 7-eleven employee in milpitas is dead. his killer still on the loose. ktvu janine de la vega is out there now with the very latest on this investigation. >> reporter: dave, i spoke with police sergeant a short time ago. she told me this is milpitas first inside homicide of the year. just to give you an idea where this is located at. we are 200 yards from the police department. as you can see behind me, people have been leaving flowers. they have been grieving. talking about the store clerk that worked inside here over

the weekend. that lost her life. now ever since the fatal shooting 7-eleven has hired a private security guard to watch the store. police were called here at the 7-eleven store at 2:15 saturday morning. they found a man suffering from a gunshot wound. he died at the scene. police have a team of detectives that have been working this case throughout the weekend. i asked if they captured the shooting. the sergeant declined to answer that. the private security guard that 7-eleven has hired for the past two days told us customers have been expressing their grief to him. >> customers telling me he was a very good man. they feel very bad. >> reporter: the victim's identity has not been released yet. i spoke to the clerk but he told me we had to leave the property. we are told in the next hour a media spokesperson may have some more information on this

case. reporting live from milpitas janine de la vega. ktvu channel 2 news. protestors with the occupy the farm movement they have done it again. daily cal reports about 30 protestors broke into the uc gone gill track. tending to the crops they planted. reported they cut a hole in the fence to get in but no one was arrested. protestors first occupied that property back in april. planting produce and setting up a tent camp. they are fighting a proposal to develop that university owned property. a vigil is planned for tomorrow for a college student from lafayette who was found deeded in the sacramento river. 20-year-old brett olson disappeared eight days ago while tubing down the river. his body was found yesterday just about a mile from where he was last seen. the 20-year-old drowned and there is no sign of foul play. olson was a student at cal polly. the vigil will begin at 7:00

tomorrow night. a memorial service is planned also for tomorrow for uc davis student le nay lomax. lomax had been missing for more than two months. authorities are now investigating how she died but they do not suspect foul play. time now 5:05. new developments in the race for the white house. president obama celebrating a fundraising victory. new numbers out show the president raised more than $114 million in the month of august. while republican presidential candidate mitt romney raised just over $111 million. now this is the first time in four months that the democrats have raised more money than the republicans. the president and mitt romney are preparing now for three debates next month. the first debate is in denver on october 3rd. it will focus on domestic policy. that will be followed by a town hall style meeting on october 16th in new york.

the final debate will be on october 22nd in florida. that will focus on foreign policy. now the vice presidential candidates will also hold a debate that is on october 11th in danville, kentucky. congress is back on capitol hill for a short preelection session. topping the agenda is stopping a government shut down when the budget year ends on september 30th. coming up at 5:15 what congress has to pass in order to keep functioning and why some lawmakers might be leaving again by friday. >> interesting. time now 5:07. pam, you didn't tell me sal is back. >> sal is back. >> good morning, sal. >> it was kicking and screaming. she had to give me a call. we will power through it together. so the traffic is actually doing pretty well. we've been talking about it earlier today in the east bay since there is a football game. the raiders. tonight at the coliseum.

7:15 start. that means that it is going to be tough in the east bay. starting any time after 2:00 or 3:00 people getting to the coliseum. the best way for you to get there is bart we are look at 80 westbound. getting to the bay bridge toll plaza westbound 80 looks pretty good. i know a lot of people are getting up early. if you are driving on 880 south from hayward to union city, word of issues southbound # 80 that has been moved to the shoulder. san mateo bridge traffic looks good out to the high-rise. let's go to steve. >> sal, thank you, sir. we have a cool down for most of the weekend. today looks a little warmer inland. not a lot. there is still fog filling in on the coast. there are cool numbers to the north. i saw kenwood 42. st. helena 46. there is some cool numbers here. it's getting that time of year. nights are getting a little longer. components of a sea breeze.

it's just there. not strong over 20 or anything. it's about 5-15 miles an hour. little system went by yesterday. slight northerly breeze will kick in today. but it's not going to be enough to clear out the coast. although it looks mild to warm down toward santa cruz. morning clouds and warmer temps inland. 60s and 70s and 80s. inland 80s. could be a few upper 80s to 90 degrees. fog, sun after that coast and bay. fog burns off. we'll have a lot of sunshine. temperatures though coming up instead of the upper 70s like we had yesterday morgan hill was 79. livermore in there. concord a little warmer. napa in there. upper 70s for many or mid 70s. 60s closer to the coast. a little cool down kicks back in on tuesday. level off on wednesday. toward the end of the week it looks a little warmer friday into saturday. cooler weather back in on sunday. a broken down muni bus. guess what, there is an app for that. how the transportation agency

we have new video of the damage caused by a series of deadly earthquakes last week in china. the first magnitude 5.6 quake hit friday in an area where some of china's poorest people live. it was followed by an equally strong quake. 81 people were killed. more than 800 others were rescued. rescue teams have been searching for more victims. a series of after shocks is raising fears more deaths and injuries could occur. the mars rover curiosity successfully landed on the planet but nasa has a controversy that could be looming if the rover comes in contact with water. curiosity drill bit may be tainted with earth microbes that could survive upon touching water. before launch engineers opened a sterilized box in order to mount the bit on to the rovers drill which was a controversial decision. our time is 5:13. after a five week recess congress goes back to work today. alison burns is live in our

washington, d.c. newsroom to tell them about the pressure they are under to avoid a financial disaster. >> reporter: the potential of a government shut down a looming again. congress has until september 30th to afree on a budget to keep -- agree on a budget to keep the government returning but the biggest challenge will be what to do about the so- called fiscal cliff at the end of the year. a series of tax increases and spending cuts that experts warn could plunge the economy back into recession. the way to deal with it is dominating the campaign trail. with romney warning if president obama is reelected. >> you will see low wage growth and there will also be this fiscal calamity at our doorstep. >> i don't believe and you don't believe that another round of tax cuts for millionaires will bring jobs back to our shores. >> reporter: a look at some of the other controversial votes scheduled for this week during my next update.

reporting live from washington, d.c. alison burns ktvu channel 2 news. a maryland pastor and delegate is backing off his efforts to stop a baltimore ravens football player from openingly supporting same sex marriage. a month ago burns wrote a letter to the ravens owner ordering him to quote muzzle linebacker ian. he is a santa cruz high school graduate has been a long-time advocate of gay rights and says he was blown away by the letter. the team issued a statement supporting the all pro player. burns is now retracting his letter saying he has the right to speak his mind. the city of oakland wants fans to celebrate its oakland teams. civic pride campaign will salute the oakland a's and raiders. fans are encouraged to read their local colors. they have been wanting to move the team to san jose and the raiders have been the subject of a move to los angeles.

time now 5:15. the reno air show races are back this week but there are major changes all because of lasteers crash. this one that killed ten people and injured 70 more. that led toward demand for better safety. organizers redesigned the airfield there increasing the distance between the planes and the grand stand by 150 feet. that separation is now at least 1,000 feet. back here at home muni hoping a new ipad app will help improve problems with its services. about 700,000 people ride muni every day. muni is dealt with issues including old streetcars and buses that sometimes break down. that's why they are hoping the new smart muni app will improve operations by having real-time information about their trains and buses. it uses gps to pinpoint the location, speed, and direction of every vehicle. when a problem happens, a text message is sent out.

now the new ktvu ipad app is ready for you to down load. you can do it this morning. you can watch all of our newscasts live. get bay area weather and video of breaking news any time anywhere. 5:16 is the time right now. let's check in with sal for a look at traffic. sal. >> pam and dave, good morning. we are looking at what we have a pretty good commute started off for a monday. this is a look at interstate 880. they were just picking up some of the road work here near the coliseum. you can see traffic is moving well in the northbound and southbound direction. just a reminder tonight there is a raiders game at the coliseum. monday night football. that game starts at 7:15. people will start showing up much earlier than that. that could impact your afternoon commute. also this morning we are looking at the westbound bay bridge. this traffic is moving along very nicely. no problem on the upper deck of the bay bridge getting into san francisco. the pattern is we usually get

615 or so backed up then. if you are driving on 880 southbound from hayward to union city it is a nice drive. all the way down to san jose. santa clara valley. freeway there is still looking good. let's go to steve. thank you. a very good morning. we had a little cool down over the weekend. very cool readings. low to mid 40s. 47 sonoma county airport. 50s elsewhere. livermore is 52. same for san jose. that is a little cool for them. a couple upper 40s. southwest 13 at travis. west, northwest out there. the big valley in stockton south, southwest. three at stockton. and west sfo. there is a little component of a sea breeze. there is no northerly wind or anything like that. it does look a little warmer inland. high pressure will nose in just for a little bit. today warm inland. warmer i should say.

effecting markets overseas. overnight investors expect the fed will want to buy more bonds in order to help lower interest rates and stimulate the u.s. economy. let's check in on our numbers. this morning just to see where we start the day. pretty quiet as you can see on friday. right now taking a look at the futures. looks like a pretty quiet opening. oil prices are on the rise. new york's main contract for october rose $.10 to $96 a barrel. so again all eyes on the u.s. fed. >> i'm sure. time now 5:20. it has been two years since the san bruno pipeline disaster. how two memorials mark that sad anniversary and how far the city has come since that tragedy. youthful indiscretions.

they were teenagers run double the double the risk of getting testicular cancer. that comes after reviewing hundreds of healthy stricken men after drug use. the study is in today's edition of the journal cancer. dozens of people participated in the sudan g. koa -- susan g. komen race for the cure this weekend. it wrapped up yesterday in san francisco. organizers say 2600 people were showed up ahead of time but that is far fewer than last year. we'll find out how much money was raised. college is back in session for many students. again, they face deep cuts to education. the budget is just one of the issues the uc board of regents plan to discuss during a three- day meeting this week at uc san francisco. if voters fail to pass the issue they could face a $250

million mid year budget cut. and tuition could go up by another 20%. compensation for university administrators is also on the agenda as well as a legal settlement for protestors that were pepper sprayed at uc davis. time now 5:24. it's been two years since that natural gas pipeline blew up in san bruno. last night people came together marking the second anniversary with two memorials. the first one was held in san bruno park. that is where that plaque was unvailed with the names of the eight people killed in that explosion. >> it's a nice way to keep fresh in people's minds what happened and to let those folks whenever they are at know that they are not forgotten. >> several other people gathered in the crestmore neighborhood for a moment of silence at 6:11 the exact moment and location of the explosion. now so far eight of the 38

good morning, to you. welcome back. this is ktvu channel 2 morning news it's a monday, september 10th i'm dave clark. >> and i'm pam cook. time now 5:30. let's check in with steve paulson. how is the weather? >> quiet. you know september we start to change a little bit here. but so far not much is changing. just settle changes. yesterday was a little cool down. today is a little warmer. there are cool numbers up in the north bay. highs today inland will come up by the coast 60s and 70s around the bay. here is sal. we are looking at the commute on the south bay in the south bay. northbound 280 traffic looks good right through here to highway 17.

we also look sat the sunol grade. 680 traffic looks good. let's go back to dave and pam. suspect of an overnight robbery in oakland realized he targeted the wrong person when his victim pulled out a gun. alex savidge is live near lake merit with more on this tense confrontation. alex. >> reporter: this was an off duty police officer who apparently turned the table ons a would-be armed robber. shooting the man during a hold up. it happened right outside of their car. it was here on lee street. it happened just before 2:00 in the morning. this is just about two blocks away from lake merit. we have video of that suspected armed robber being transported arthritis morning. the officer and woman just parked their car and opened up the trunk when a according to a sergeant i spoke to the armed robber approached them from behind and demanded their values. that is when the police officer pulled a gun and fired on the man that was trying to rob him.

>> he drew his service pistol and shot him a couple times. the suspect is in the hospital in stable condition. >> reporter: the sergeant tells me that suspected armed robber that was shot had been involved in two other armed robberies earlier on just tonight. so he went around he was robbing several people earlier on this evening. but apparently targeted the wrong victim here on lee street and this off duty police officer opened fire on the armed robber. the armed robber taken to the hospital recovering from two gunshot wounds this morning and facing several charges including armed robbery. the sergeant i asked him which department his off duty police officer works for. at this point he will not tell us which department that officer works for. live this morning alex savidge. a san leandro man has been critically injured in a mysterious shooting. the 48-year-old victim was found shot several times at 8:30 last night in a duplex on

orchard street near william. the victim is in critical condition at castro valley eden medical center. detectives have not found the gunman and they do not know why somebody would have wanted to shoot him. 5:32. tonight vallejo residents will get to question the acting police chief at the city's seventh officer involved shooting of the year. 23-year-old mario romero was shot to death last sunday. police say he got out of a car holding what appeared to be a gun. out of the seven officer involved shootings in vallejo, five of them have been deadly. some of the residents say vallejo needs to have a citizens review commission overseeing police activity. the meeting tonight is at 6:30. it will be in the city hall council chambers. a father and son safe this morning after being rescued from a sinking plane off the coast of california. ktvu tara moriarty is here now to tell us about the challenges the rescuers faced and what the

victims said when they were rescued. good morning, tara. >> reporter: good morning. every year this father and son make ha trip they fly in their small plane from santa barbara up to canada. this year something went horriblely wrong. their engine started to have problem and they were forced to make an emergency landing off the coast near big sur. the coast guard came to their rescue. crews had to brave six to eight foot swells to get to the pair and the may day call came in just after 3:00 yesterday afternoon. by 5:15 the plane got tangled up in kelp and complete lessoning. what was the pair's reaction after they had been rescued? >> grateful they were glad to see us. definitely. glad to be rescued. >> there is a crew of four and we all do what we train for every day. and it's nice to walk away and save a couple lives.

>> reporter: now officials say it was a gps tracking device on board the pairs aircraft that helped the coast guard help pinpoint them. the older man described in his 70s was suffering from hyperthermia. the son in his 30s was okay. their names have not been released. we are live near sfo i'm tara moriarty. one man is facing vehicle manslaughter after a crash in walnut creek. on saturday night police say a red pickup truck lost control, drove up on the sidewalk and hit two women. one of them 52-year-old sherry hicks died at the scene. her daughter-in-law was injured and taken to john mere medical center. the accident is still under investigation. >> it's hard to attribute anything to like you know bad laws or like the streets being too wide or unsafe or anything like that. i think it's mostly freak accidents. >> the driver of the truck has been identified as 53-year-old

hussein tabrizi of walnut creek. police have not said if drugs or alcohol were solved. the victim of a fatal crash has been identified as the owner of a local restaurant. he was driving on 280 saturday night when he ran into a concrete walk near the 380 connector. he was the owner of don picos restaurant. they are looking into whether he suffered a medical problem in the moments before the crash. president obama offering his condolences to the family of a florida police officer who died while a part of the president's motorcade yesterday. officer bruce lover rand was preparing to shut down a road in palm beach when he was hit by a pickup truck. he was a 20 year veteran of the florida police force. sheriff office says the investigation continues. so far no charges have been filed against that pickup truck driver. also new this morning the u.s. government has just given

afghan officials full control of a prison where thousands of taliban and terrorist suspects are being detained. hamid karzai called that a victory for afghan sovereignty. right now it houses 3,000 detainees. however, the u.s. recently stopped transferring new suspects there after afghan officials questioned the long- term detentions without charges. a somber anniversary tomorrow. it has been 11 years since the september 11th terror attacks. coming up in nine minutes the local events where you can pay your respects. time now 5:37. sal is back. he will get you to where you need to go this morning. you are watching the toll plaza and everything else. >> that is right we are starting there dave and pam. we are look at the approach to the bay bridge. a lot of people have to use it getting into the city. let's go there and take a look at traffic. you can see traffic has become a little bit more crowded in the last few minutes here.

westbound getting into the city. also this morning on interstate 880 northbound it looks like they are picking up road work and right in front of the coliseum we have a couple trucks with the flashing lights. just give yourself an extra few minutes to drive through there. today there is going to be a lot of activity at the coliseum as the raiders host the san diego chargers on monday night football. 7:15 nationally televised game sold out. it's going to be a big one. so you know just make sure if you drive through here, don't be surprised by that. and if you're going to the game good way to get there is take bart. also the morning commute on northbound 17, northbound 85 that traffic is moving along very nicely northbound 280 traffic looks good into the valley. 5:38 let's go to steve. there is also an early game, sal. >> there is another early game. there is a double header. >> there is. we have a little bit in the way of fog. inland temp there is is cool numbers out here. kenwood is 42.

sonoma two readings at 44. fairfax 47. and palo alto checking in at 47. and believe it or not i did see a 36 up at leo ma. that is up at 2800 feet. still the nights are getting a little longer here. 47 sonoma county airport. napa airport is 56. they have cloudy skies. in napa itself there are upper 40s as well. livermore is low 50s. san jose 52. i know there is upper 40s around los gatos. southwest 13 or west, north west or southwest wind. there is a little component of a sea breeze. but temperatures inland will come up a little bit. yesterday we bottomed out. high pressure kind of building in slightly. warmer inland after the morning clouds. 60s and 70s and 80s. it will be warmer down toward santa cruz. fog is increasing. but not going very far. there is some inland. fog, sun mild to warm. cool for others. temperatures still a pretty good spread here. 60s to 70s.

foreign. some coast -- good morning. coastal and bay temperatures. 80s there and 60s and 70s closer to it. here's a quick look at some of the top stories we are following for you right now. an armed robber in oakland shot by an off duty police officer just hours ago. that off duty police officer and female friend were getting out of their car when that robber walked up. the police officer pulled out his gun and shot the armed robber. police say that suspect is responsible for two other robberies in the area overnight. a father and son were rescued from their sinking plane after it crashed into the waters off the central coast. the coast guard says the planes engine stalled after taking off

opting out of vaccinations. according to a study by the associated press, the number of parents who do not vaccinate their kids in private schools is more than two times greater than the number of pub like school parents that do. now it also shows that not even the reemergents of whooping cough is leading private schools to vaccinate. authorities in washington state are evacuating residents and close to 200 homes. it's just one of more than 80 fires that broke out over the weekend caused by an estimated 4,000 lightning strikes. the homes are near the 500-acre canyons fire. another fire near white salmon still burning more than 1600 acres. so far no injuries reported. california battling our own set of fire. nine major fires burning across the state. lake county scotts fire threatening about 300 homes just outside of ukiah.
